RILA TERMS OF USE

These Terms of Use constitute a legally binding agreement between the user and iNews LLC, located at 254 Chapman Rd, Suite 208, ZIP 22965, United States, regarding the access and use of the service called RILA, available through the website and associated applications. By using RILA, the user fully accepts these Terms of Use. If the user does not agree with any of its terms, they must refrain from using the service.

1. Nature and Scope of the Service

RILA is a digital platform that allows users to upload files and links, including PDF or DOC documents, audio files, URLs, and text, in order to generate summaries, audio, flashcards, and other derived elements through the use of artificial intelligence-based technologies. RILA also allows for the storage of results, subsequent queries, and integration with external services authorized by the user.

The maximum allowed file size is fifteen (15) megabytes. The generated or stored content by the user will be retained as long as the user has accessed their account within a period not exceeding three (3) months. iNews LLC reserves the right to modify, suspend, or expand the service's functionalities without prior notice.

2. Eligibility

The use of RILA is strictly limited to individuals over eighteen (18) years of age. The user declares and warrants that they have full legal capacity to enter into this agreement and that the information they provide will be accurate, current, and truthful. The use of the service for illicit, fraudulent, or purposes contrary to these Terms of Use is prohibited.

3. User-Uploaded Content

The user is solely responsible for the content they enter, upload, store, or transmit through RILA. This includes, but is not limited to, documents, files, audio, text, links, and any other material. The user declares that they own all necessary rights to such content or have the corresponding authorizations for its use, distribution, and processing.

It is expressly forbidden to upload illegal, offensive content, content that infringes on the intellectual or industrial property rights of third parties, that violates the privacy of other people, that constitutes malware, harmful code, or that attempts to compromise the integrity of the service.

The user retains full ownership of their content; however, they grant iNews LLC a limited, non-exclusive, worldwide, and revocable license to store, process, transform, and reproduce said content to the extent strictly necessary for the provision of the service.

4. Processing via Artificial Intelligence

In order to provide its functionalities, RILA may send content to external artificial intelligence-based services, including but not limited to OpenAI, Google Gemini, or other technology providers. The user acknowledges and accepts that the processing may generate inaccurate, partial, or erroneous information, and that iNews LLC does not guarantee the accuracy, truthfulness, or suitability of the content generated by artificial intelligence. The user will be responsible for verifying and reviewing any result obtained through the service.

5. Data Storage and Deletion

The original files uploaded by the user, such as PDFs or DOC format documents, will be kept only for an approximate period of one (1) to two (2) days, after which they will be automatically deleted. The audios, cards, summaries, and derivatives generated by RILA will remain available as long as the user logs activity in their account at least once every three (3) months.

If the user requests the deletion of their account, iNews LLC will proceed to permanently delete all content associated with said account, including files, audios, summaries, tokens, preferences, and any other linked information.

6. Integrations with External Services

RILA offers the ability to send content directly to third-party platforms such as Notion and Evernote, through express authorization from the user. To ensure service continuity, iNews LLC will store encrypted access and refresh tokens generated during the OAuth authorization process. These tokens will be used exclusively for the purpose of executing the actions requested by the user on said external platforms.

iNews LLC does not control and is not responsible for the operation, availability, changes, interruptions, failures, or losses arising from the services provided by third parties. The revocation of permissions or interruption of access must be managed directly from the interfaces of each platform or from the RILA settings.

7. Personal Data and Privacy

For the provision of the service, iNews LLC may collect information such as email address, uploaded files, entered content, usage logs, IP addresses, preferences, and data derived from analytics. This information will be used exclusively for the purpose of providing, maintaining, improving, and ensuring the operation of RILA.

iNews LLC does not sell, rent, transfer, or otherwise trade user data. Data may be shared only with necessary providers for the operation of the service, such as artificial intelligence platforms, payment processors, or analytics services.

The user acknowledges and accepts that all data will be processed and stored within the United States of America. RILA is not subject to the European GDPR regulation.

8. Points, Plans, and Payments

RILA offers a free plan that includes thirty (30) monthly points for content generation and processing. Points have no monetary value, are not redeemable for cash, and are non-refundable under any circumstances. Additional points or paid plans may be purchased through the methods enabled by iNews LLC, primarily Stripe. iNews LLC does not store credit or debit card information.

iNews LLC reserves the right to modify the prices, conditions, and benefits associated with the plans or points at any time.

9. Security

iNews LLC implements reasonable security measures to protect the information stored in RILA, including encryption of communications and tokens. However, the user acknowledges that no digital system is completely secure and that there may be inherent risks to the electronic transmission and storage of data. The user uses the service at their own risk.

10. Limitation of Liability

RILA is provided "as is" and "as available." iNews LLC offers no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of the generated content, or continuous availability of the service.

iNews LLC will not be liable, in any case, for indirect, incidental, consequential damages, loss of profits, loss of data, loss of reputation, business interruptions, nor for any damage arising from the use or inability to use the service. Likewise, iNews LLC will not be responsible for the content uploaded by the user or for failures of third-party services used by RILA.

11. Suspension and Termination

iNews LLC may suspend or terminate the user's access to RILA, with or without prior notice, in case of breach of these Terms of Use, abusive activities, attempts to compromise the security of the service, or any use that iNews LLC considers harmful to the system or to third parties. The suspension or termination of access may result in the loss of content, points, or settings without the right to compensation.

12. Modifications to the Terms of Use

iNews LLC may modify these Terms of Use at any time. Such modifications will become effective upon their publication on the corresponding website or platform. The continued use of RILA by the user will constitute full acceptance of the new terms.

13. Applicable Law and Jurisdiction

This agreement shall be governed and interpreted in accordance with the laws of the State of Delaware, United States of America. Any controversy arising from the use of the service or the interpretation of these Terms of Use will be submitted exclusively to the competent state or federal courts in the State of Delaware.
